7. Dispute Resolution

In the event of a dispute, claim, or controversy arising out of or relating to your use of our Service, or the breach, termination, enforcement, interpretation, or validity of these Terms or any part of them ("Dispute"), both you and Classical Psychotherapy, PC agree to first attempt to resolve the Dispute informally or through mediation, in good faith, before resorting to arbitration. This arbitration provision shall survive termination of these Terms.

Prior to initiating arbitration, the parties shall engage in a mediation process to be conducted by a mutually agreed upon mediator, in an effort to resolve any Dispute in a cooperative and efficient manner. Mediation shall occur in Raleigh, NC, USA, or another mutually agreed location, and each party shall bear its own costs in mediation. Should mediation not result in a resolution, the Dispute shall then proceed to binding arbitration.

Any arbitration under these Terms will be conducted on an individual basis; class arbitrations and class actions are not permitted. The arbitration will be conducted by an Arbitration Association chosen by Classical Psychotherapy, PC, under its rules and pursuant to the laws of the State of North Carolina. Each party will be responsible for paying any arbitration filing, administrative, and arbitrator fees in accordance with the Arbitration Association’s rules, except as provided in the mediation step. YOU AND CLASSICAL PSYCHOTHERAPY, PC HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY, except as otherwise stated in this Agreement. You and Classical Psychotherapy, PC are instead electing that all covered claims and disputes shall first seek resolution through mediation, and if necessary, resolved by arbitration under this Arbitration Agreement.

8. Governing Law

These Terms of Service and any disputes arising out of or related to the Service shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes to Terms of Service

We reserve the right to modify these Terms of Service at any time. We will provide notice of any significant changes by posting the new Terms of Service on our website with a date posted at the top of the site when it was last updated. Your continued use of the Service after such changes will constitute your consent to the updated terms.
